A method for turning a vague "what happened here?" into documents with dates, names, and citations. Built for environmental, regulatory, and land-use questions, but the same loop works for any public body.

The loop

1. Name the question as a record, not a story. "Was the landfill tested for PFAS before it was capped, and what did the results say?" Not "is the landfill dangerous?" Records questions have records answers.
2. Find who holds the records. There is almost always more than one holder:
   • the state environmental agency (permits, inspections, enforcement, monitoring reports)
   • the regional or federal agency if there is a delegated program or a federal nexus
   • the county (health, drain, register of deeds, assessor)
   • the municipality (council minutes, consultant reports, contracts)
   • the current owner or successor company (for a private site, they often post their own reports)
3. Match the law to the holder. Federal agencies respond under the federal Freedom of Information Act, 5 U.S.C. § 552 (enacted 1966, amended by the FOIA Improvement Act of 2016). State and local bodies respond under their own state public-records law (for example Michigan's FOIA, MCL 15.231 et seq.). Do not cite the federal statute to a city clerk; cite the state act.
4. Check what is already public first. Many agencies run an online reading room or document release archive. Read it before filing, so the request is about the gap, not the whole archive. If the records are already posted by the owner, say so and cite that page.
5. Scope one request. One request, listing every office and record type you want searched. Duplicate requests cause delays. Describe records by kind, date range, and subject, not by asking a question.
6. File it. Send to the agency's designated records office (many accept a web form, email, or fax; a central portal exists for federal requests). Keep the submission confirmation.
7. Track, then appeal. A federal agency normally responds within 20 working days, with possible extensions for unusual circumstances, processed in order of receipt. Narrow, dated requests move faster than broad ones. If records are withheld, remember that the nine exemptions at § 552(b)(1)-(9) permit withholding but do not require it; the agency must reasonably foresee harm to a protected interest, and the burden to sustain the withholding is on the agency. Administrative appeal comes first, then judicial review; an agency FOIA Public Liaison can resolve disputes informally.
8. Build the timeline. From what returns, extract dated, attributable facts. Every line gets a document, a page, and a date. Where a fact is inferred, label it inferred.

Fee waivers

Federal: disclosure likely to contribute significantly to public understanding of government operations, and not primarily in the requester's commercial interest. Many state acts have an equivalent public-interest standard. Ask for the waiver in the request itself and say how the records serve the public.

What a good product looks like

A dated sequence, not a pile of PDFs. The value is in the ordering: who knew, when did they know, what did they do with it, and what did the record omit. A finding that no one has pulled before is worth more than a summary of a report already online.
